The Supreme Court decision regarding conflicting environmental protection and cultural heritage interests

The Supreme Court clarified in its decision on January 15, 2024, the weighing of conflicting interests between environmental protection and cultural heritage. The Minister of Culture established a protection zone extending to the reservoir for the Linnamäe dam structure, which falls under cultural heritage protection. Meanwhile, the Environmental Board is in the process of assessing the impact on Natura, which will determine the permissibility of damming the protected Jägala River.

The Court of Justice of the European Union has passed a ruling in a case represented by FORT

On the 21st of December this year, the Court of Justice of the European Union (CJEU) has made a judgment in case No C-421/22, concerning highly important public procurement organized by the Road Transport Administration (RTA) in 2019. The CJEU evaluated compliance of procurement rules and requirements with the Regulation No 1370/2007 on public passenger transport services by rail and by road (Regulation).

The public procurement announced in the year 2019 for provision of public transport services by buses on the network of regional routes was the then largest in scale in Latvia. The prospective price of the announced tender for ten years was 447 million euros.

Law firm FORT Tallinn provided counsel to Kapitel AS and Tristafan OÜ in a significant transaction, likely to be the largest real estate deal in Estonia this year. The transaction involved the acquisition of shares in Viru Keskus from Kapitel's long-term collaborator and co-owner, Pontos Group.
